A Frisco marketing firm we worked with last quarter discovered something that surprised the owner. Their copywriter was using an artificial intelligence writing assistant that nobody on the leadership team had ever heard of. The tool was free. It was helpful. It was also quietly sending every client brief, internal strategy memo, and draft press release to a server in another country, where the data was being used to train future versions of the model. The owner did not know. The IT contractor did not know. The contract signed three months earlier explicitly said that any data submitted would be retained and used. That is shadow AI, and if your business has more than five employees, you almost certainly have it too.
This is the new face of business technology risk in 2026. It is not a hacker breaking down the front door. It is your own team, with the best of intentions, quietly opening side doors that nobody knows about. For business owners and operations managers in McKinney, Allen, Plano, Frisco, and across Collin County, this is now the single fastest growing source of legal, regulatory, and reputational exposure that we see in our work. What Shadow AI Actually Is
Shadow AI is the name for any artificial intelligence tool, browser extension, or automated assistant that someone in your business is using without anyone in management or IT having approved it, documented it, or evaluated it for risk. It is the same idea as shadow IT, which was the term we used for years to describe the rogue Dropbox accounts, personal Gmail addresses, and unsanctioned project management tools that employees would sign up for to make their jobs easier. Shadow AI is the next generation of that same problem, and it is moving much faster.
The reason it is moving faster is that AI tools are being released and adopted at a pace that traditional software never was. A new chat assistant launches on Monday, gets shared in a Slack channel by Wednesday, and by Friday three people in accounting are pasting client invoices into it to summarize them. Nobody filed a request. Nobody read the terms of service. Nobody asked whether the data is encrypted, retained on the vendor servers, or fed back into the model training set. They just wanted to save twenty minutes on a Friday afternoon.
The tools themselves are often legitimate. The problem is not the technology. The problem is that you have lost visibility into what data is leaving your business, where it is going, and what is happening to it. If a state attorney general, an insurance underwriter, or a client procurement team asks you a simple question like what AI systems process your customer data, you need to be able to answer it. Right now, most North Texas businesses cannot.
The Real Cost of an AI Tool You Did Not Know You Had
When we sit down with owners to explain why this matters, we do not lead with the technology. We lead with the bill. A shadow AI exposure has four cost categories, and any one of them can be devastating for a small or mid sized business.
The first cost is regulatory. If your business handles protected health information, then HIPAA still applies even when the data is being processed by an AI tool. If your business handles credit card data, the same is true of PCI compliance. If you have clients in California, Colorado, Connecticut, or any of the other dozen states with active consumer privacy laws, those laws apply to AI processing too. You are responsible for your data wherever it goes, and an employee pasted it into a free chatbot is not a legal defense.
The second cost is contractual. Most business to business contracts signed in the last five years contain language about data handling, subcontractors, and approved technology providers. When your team feeds client data into an unapproved AI service, you are quietly putting yourself in breach of contracts that you signed and that your clients are counting on. We have seen contracts terminated and master service agreements voided over exactly this kind of discovery, and the affected business often does not learn about it until the renewal call.
The third cost is insurance. Cyber insurance policies have tightened dramatically over the last two years, and almost every carrier now asks specific questions about AI governance during renewal. If you have an incident, and the underwriter discovers that the business had no AI policy and no inventory of AI tools in use, expect either a denial of the claim or a sharp premium increase at renewal. Your broker will tell you the same thing if you ask them today.
The fourth cost is reputational. When a client learns that their information was processed by a system they never agreed to, the trust takes years to rebuild. Sometimes it never does. We worked with a North Texas accounting firm that lost two of its three largest clients within sixty days of a shadow AI disclosure. Neither client filed a lawsuit. They simply walked away.
Three Recent Incidents That Should Worry Every Business Owner
We track real incidents involving AI systems every day, and three from the past few months illustrate why this is not a theoretical risk.
The first is a flaw discovered this spring in an open source AI deployment tool called LMDeploy. Without getting into the technical weeds, the flaw let an attacker make an AI server reach across your network and pull data from your file servers, accounting system, or internal applications. If your IT team is running any kind of AI deployment, and most do not even know which ones the marketing department spun up last quarter, this is a real and immediate problem.
The second was a remote code execution flaw in a popular AI agent builder called Flowise. Remote code execution is the worst case in security work, where an outsider sends a request to your system and gets it to run any command they want. That is the digital equivalent of giving a stranger the keys to your office and the password to your safe. These tools are popular with developers building internal automations, and those automations run on company infrastructure with access to company data, often without executive awareness.
The third is a class of incidents involving a framework called LangChain, the most widely used building block for custom AI applications today. Vulnerabilities in 2026 have created a new wave of legal liability questions because the framework is so widely embedded in commercial software. If you bought any product in the last two years that includes a chat with our AI assistant feature, there is a real chance it is built on top of LangChain, and the security responsibility is genuinely unclear. How Shadow AI Slips Past Your IT Department
If you have an internal IT person or an outsourced provider, you might assume they would catch this. In most cases, they will not, and the reasons are worth understanding.
Traditional IT monitoring looks for software being installed on company devices. Shadow AI almost never gets installed. It runs in a browser tab. It is a website. From the perspective of every endpoint protection tool on the market, an employee using a shadow AI service looks identical to an employee reading the news. The data leaves through a normal web request, encrypted, on standard ports. There is nothing to flag.
The other blind spot is mobile. Most shadow AI usage happens on phones, often on personal phones that are also used for work. A salesperson takes a picture of a handwritten meeting note, runs it through an AI app to convert it to text, and the resulting transcript is now sitting on a server somewhere in the cloud, indexed and searchable. Your IT department has no visibility into this and no way to stop it without policies, training, and the right monitoring tools in place.
This is one reason that traditional vulnerability scanning only solves part of the problem. Vulnerability scanning, which is the automated checking of your systems for known security flaws, is essential. But it cannot tell you that someone in marketing is using a free AI service that retains every prompt. For that, you need a different kind of assessment, and you need it as part of an ongoing program.
What a Shadow AI Risk Sweep Actually Looks Like
When we run a shadow AI sweep for a client, the work is not glamorous, and it is not technical in a way that should intimidate you. We start by talking to people. We sit with each department head and ask very specific questions. What tools did you start using in the last six months. What free trials did you sign up for. What browser extensions are installed. What apps are on the work phone. The honest answers from a thirty minute conversation often surface five or six AI tools that nobody at the leadership level had heard of.
Next we look at the actual network traffic, which sounds technical but is really just running a set of automated checks that flag connections to known AI service providers. This catches the tools that people forgot to mention, or that they are using through a personal account on a work device. We compare what we find against what was disclosed in the conversations, and the gap between those two lists is usually where the real risk lives.
Then we look at contracts and terms of service for everything we found. This is the step that most businesses skip, because it is tedious. But it is also where we find that a tool the office manager has been using for six months explicitly retains every uploaded document for model improvement purposes. That is the language that gets businesses in trouble.

We see it most often in real estate, healthcare, professional services, and the technology companies that have moved their headquarters to Frisco and Plano in the last five years.
Real estate firms are exposed because agents handle sensitive personal and financial information about buyers and sellers, and the industry has been quick to adopt AI for listing descriptions, market analysis, and client communications. Healthcare practices in McKinney and Allen are exposed because the workforce is trying to reduce documentation burden and AI scribing tools have flooded the market without consistent oversight. Professional services firms, including accountants, lawyers, and consultants, are exposed because the work product itself is highly sensitive and the time pressure is constant. And the larger technology employers in Plano and Frisco are exposed because their employees were early adopters of every AI tool that hit the market, often before any internal policy existed.
The other reality of doing business in North Texas right now is that the regulatory environment is changing quickly. Texas passed its own consumer data privacy law that took effect in 2024 and added AI specific provisions in 2025. Federal regulators have made clear that they consider AI governance to be a board level responsibility for any business that handles consumer data. What To Do This Week
The first step does not require buying anything. Send a short email to every department head asking them to list every AI tool, browser extension, or automated assistant that anyone on their team is currently using. Ask for the name of the tool, what it is being used for, who is paying for it, and what data is being put into it. The list will be longer than you expect, and the gaps will be revealing on their own.
The second step is to write a one page policy. It does not need to be a legal document. It needs to say what is allowed, what is prohibited, what requires approval, and what to do if someone is unsure. The third step is to schedule an outside assessment. The reason this matters is that internal teams almost always miss things, and the conversations are often easier when an outside party is asking the questions.
